Disclosure Mandate for AI Usage in Creative Industries
A new regulation concerning the use of artificial intelligence has been established, requiring transparency about AI integration in various products, including video games. This mandate, which will come into effect early next year, obliges developers to inform users when artificial intelligence plays a part in their product's creation or functionality. Video games, which have long utilized AI to enhance gameplay and player interaction, are now subject to this law. Developers must not only disclose AI usage but also establish systems for assessing and managing associated risks. The scope of disclosure extends beyond interactive gameplay elements to encompass AI-generated visuals, audio, and 3D models.
The legislative landscape is evolving as lawmakers address the growing role of AI in creative fields. According to Rep. Kang Yu-jung, video games employing even partial AI contributions are considered AI products under the new framework. This classification places game publishers within the AI industry. However, the application of these regulations may vary based on the extent of generative AI utilization and the level of human input involved in the final product. As noted by the National Assembly Research Service, achieving balance between technological advancement and human creativity remains crucial.
Rep. Kang highlighted the necessity for policies that protect creators' rights while fostering industry growth. With the rapid expansion of AI applications in gaming, traditional boundaries between human creativity and machine-generated content are becoming blurred. The Basic Act on AI Development and Trust Foundation, enacted earlier this year, aims to provide legal guidance for integrating AI into creative industries such as music, film, and animation. These sectors face challenges in adapting to the increasing prevalence of AI-generated content.
In response to these changes, organizations like the Korea Music Copyright Association have introduced measures requiring songwriters to confirm non-AI involvement in their compositions. This stance reflects broader concerns about copyright implications and the authenticity of creative works in an era of advanced technology. As the industry grapples with these issues, finding equilibrium between innovation and preservation of artistic integrity becomes paramount.
This legislation marks a significant step toward regulating AI use in creative endeavors.
